Terms & Conditions

Please take the time to read and understand the conditions of booking set out below prior to booking a trip with us. Tasty Tours reserves the right to update Terms and Conditions at any time as required to meet industry standards and regulations.

 

Definitions

‘Us’, ‘we’ or ‘our’ refers to Tasty Tours Pty Ltd (ABN 89 642 232 139)

‘You’, ‘your’, ‘participant(s)’ or ‘group(s)’ refers to a person who has booked and paid for a tour or activity

Booking contract

By booking a tour or activity with Tasty Tours (ABN 89 642 232 139) you are accepting these Terms and Conditions (which constitutes the entire agreement between you and us) without alteration and your booking will be accepted by us on this basis.

Booking on behalf of others

When booking on behalf of other participants, you are deemed to be the designated contact person for every participant included on that booking. This means that you are responsible for making all payments due in connection with your booking and notifying Tasty Tours of any changes or cancellations. You are responsible for informing your group of these Terms and Conditions and any changes of itinerary.

 

All participants must be 18 years or older. Due to licensing requirements, all participants are required to carry photo identification (Australian/International drivers’ licence), Australian Proof of Age card, Australia Post Keypass Identity Card or Australian/International passport) for the duration of the tour. Failure to do so will result in your inability to participate in the tour.

 

By booking on behalf of another participant(s), you represent and guarantee that you have obtained all required consents. You are responsible for verifying that any information you provide on behalf of another participant is complete and accurate. Under no circumstances will Tasty Tours be liable for any errors or omissions in the information provided to complete a booking.

 

Prices and payment

Payment is required in full at the time of booking. Bookings are required to be made via our online booking system. Your booking will only be deemed final once you have been issued a receipt and booking confirmation.

 

If you are unable to book via our online booking system, bookings can be made via phone or email. Payment is required in full and your booking will only be deemed final once you have been issued a receipt and booking confirmation.

 

All prices on our website are current and supersede any previously advertised pricing, are in Australian Dollars (AUD) and are inclusive of GST.

 

Tasty Tours reserves the right to amend advertised tour prices at any time.

Tour inclusions and exclusions

The price of each tour includes:

  • Licensed and experienced driver and tour guide

  • Transport by comfortable and air-conditioned vehicle (vehicles may vary depending on size of group and availability), all vehicles are equipped with first aid kits, fire extinguishers, hand sanitiser, antibacterial wipes, face masks, tissues and Mentos mints

  • Venue tours, food, drinks and tastings as per each tour description on website

  • Metal water bottle with water

 

The price of each tour excludes:

  • Additional food and beverages outside of product description on website

  • Products, produce, merchandise and souvenirs

 

Departure guarantee and itinerary amendments

Tasty Tours guarantees that all scheduled tours with a minimum of four (4) paying participants, will depart as indicated on the applicable confirmation, subject to reasonable itinerary changes as described in these Terms and Conditions. This guarantee is not applicable in the case of Force Majeure.

 

While we endeavour to operate all trips as described, Tasty Tours reserve the right to change any part of a tour itinerary to accommodate venue operations and other circumstances beyond our control. Tasty Tours is not able to influence or control a venue or its operations.

 

If changes are made to your tour, we will make every reasonable effort to communicate this to you prior to your booking date.

 

Cancellations by Tasty Tours

Tasty Tours reserve the right to cancel a tour at any time prior to departure if, due to terrorism, natural disasters, political instability, or other external events it is not viable for us to operate the tour.

 

If we cancel your tour, you will have the choice of:

  • Transferring to an alternate date (subject to availability)

  • Transferring to an alternate tour of the same or lesser value (subject to availability)

  • Receive a credit note for the paid amount to be used at a later date

  • Transfer your booking to another person

  • Receive a full refund of tour price

 

Tasty Tours are not responsible for any incidental expenses that you may incur as a result of your booking including but not limited to visas, travel insurance excess, accommodation, or non-refundable flights.

 

Cancellations and amendments by the participant

Cancellations must be requested in writing to Tasty Tours via email (info@tastytours.com.au) and will only be effective once you have received written acceptance of the cancellation by Tasty Tours.

 

Tasty Tours will, to the best of their ability contact you by phone and text message if you are late to join a tour or missing part of the tour. If you fail to join a tour or leave prior to its completion, no refund will be made. This includes but is not limited to failing to be at pick up points at confirmed times or leaving the pick-up location.

 

Tasty Tours are not obliged to issue refunds for unused services.

 

Cancellation refunds will be issued as follows:

  • Between 0 (day of tour) and 14 days prior to the tour: no refund

  • 15 - 30 days prior to the tour: 50% of the tour price and booking fee per person

  • 31 days or more prior to the tour: 100% of the tour price and booking fee per person

 

Change of date refunds will be issued as follows:

  • Between 0 (day of tour) and 14 days prior to the tour: $30 transfer fee per participant

  • 15 days or more before the tour: no transfer fee

Cancellation due to COVID-19 restrictions

Cancellations due to border closures/restrictions, lockdowns etc. are 100% refundable. Alternatively your booking can be rescheduled.

Authority on tour  

Our tours are run by experienced tour guides. The decision of your tour guide is final on all matters likely to affect the safety or well-being of any participant, your tour guide, or venue staff participating in the tour. If you fail to comply with a decision made by a group leader or interfere with the well-being or mobility of the group, your tour guide may direct you to leave the tour immediately, with no right of refund.  We may also elect not to carry you on any future tours booked.

 

You must at all times comply with the state and federal laws regarding lawful drinking practices including, but not limited to, Responsible Service of Alcohol (RSA) laws, the consumption of alcohol in public places, in vehicles and consumption of ‘bring your own’ (BYO) alcohol.

 

Safety

Tours that involve visiting working breweries, wineries, distilleries, and kitchens may require closed shoes or other protective clothing and/or equipment. Details of these requirements are clearly stated in tour description on our website and it is your responsibility to ensure you dress appropriately for your chosen tour. Failure to do so may result in your inability to participate in the tour.

 

Alcohol must not be consumed in a public place in Queensland unless the area is a licensed premise or is declared as a 'wet area'. Authorities can issue you with an on-the-spot fine for drinking alcohol in a public place. Unlicensed premises include any vehicle owned or operated by Tasty Tours.

 

Tasty Tours have a duty of care for all their participants, staff, venue, and suppliers and promote the Responsible Service of Alcohol and responsible drinking practices. If you are deemed heavily intoxicated you may be cut off from further tastings and alcohol consumption by your tour guide, venue, or supplier staff. No refund or compensation will be offered or provided if you have been refused alcohol for being too intoxicated.

 

Participants are responsible for their own behaviour and any damage caused during the tour to property and equipment owned and or hired by Tasty Tours, venues, and suppliers. A minimum damage fee of $500 will apply to any damage, spillage, vomit, etc. on any Tasty Tours owned or operated vehicle. By agreeing to these Terms and Conditions you consent to us charging your credit card to cover the costs of any damage incurred by you or your group.

 

Smoking is not permitted ​on any Tasty Tours owned or operated vehicle. Smoking restrictions apply at wineries, breweries, distilleries, restaurants, and other tour venues and locations. Please check signage or asks your tour guide to locate smoking areas are.

 

Tasty Tours aim to give you access to high quality, great-tasting wine, beer and produce throughout your tour experience. You will be able to purchase wine, beer, and produce at most venues and suppliers, which we will securely store in the Tasty Tours vehicle for you. Purchases of alcohol must not be opened or consumed in any form on any Tasty Tours owned or operated vehicle.

Limitation of liability

We contract with a network of venues, service providers, and individuals to assist in the running of our tours as third parties. We are not responsible for the acts and omissions of these third parties.

 

To the fullest extent permitted by law:

Any liability for any loss, death, injury, or damage which you may suffer (directly or indirectly) in connection with or arising out of your participation in a trip, or any breach of the Terms and Conditions, is excluded

 

You release Tasty Tours and our officers, employees, and representatives from any liability and expressly waive any claims you may have against us arising out of or in connection with your participation in a trip; and any condition or warranty which would otherwise be implied by law into these Terms and Conditions (Implied Warranty), is excluded.

 

To the extent an Implied Warranty cannot be excluded, our liability in respect of the Implied Warranty is limited to (in our absolute discretion): (i) the provision of a similar trip to an equivalent value; or (ii) a refund of the total amount received by us from you in connection with your booking.

 

Any claim by you is excluded to the extent that it is for indirect or consequential loss, loss of profits or economic loss, however it arises, or for indirect, special, punitive, or exemplary damages.

 

Liability of Booking Agents

Any tours and/or vouchers sold by a Booking Agent on behalf of Tasty Tours, the Booking Agent indemnifies Tasty Tours against:

  • All losses and liabilities incurred by Tasty Tours

  • All costs payable by Tasty Tours to its legal representatives (whether or not under a costs agreement) and other expenses incurred by Tasty Tours in connection with a demand, action, arbitration (including mediation, out of court settlement or appeal); arising directly or indirectly as a result of or in connection with any acts or omissions of the Booking Agent.

 

Complaints

If you have a complaint or are dissatisfied with any part of your tour, please inform your tour guide at the time in order that they can attempt to rectify the matter. If satisfaction is not reached through these means, then any further complaint should be put in writing to us (info@Tastytours.com.au) within 30 days of the end of the tour.

 

Photos and marketing

By attending a Tasty Tours tour, you agree to be photographed and or filmed and consent to us using images of you taken during the tour for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable licence to use such images for publicity and promotional purposes.

 

Privacy policy

Any personal information collected by Tasty Tours about you may be used for any purpose associated with the operation of a tour or to send you marketing material in relation to our special offers and events. The information may be disclosed to our service providers to enable us to operate the tour. We will otherwise treat your details in accordance with our privacy policy (available for viewing here).

 

Copyright 

The contents of this website are copyright by Tasty Tours 2020. You may access and/or display these pages on a computer or monitor or mobile device as well as print out and copy for your personal use only, any whole page or pages in this website. All other use, copying or reproduction of any part of this website is prohibited except as permitted under the Copyright Act 1968 (Cth). Without limiting the foregoing, no part of this website may be reproduced on any other Internet site. 

 

Governing law and jurisdiction 

By accepting these Terms and Conditions you agree that the terms of this agreement are governed by the law of Queensland and any dispute shall be heard by the court of appropriate jurisdiction in Queensland.
